The Department completed its Final Navigability report on the Sandy River from River Mile 0.0 to 37.5 in January 2002. Based on the evidence of the historical use and condition of the Sandy River presented in this report and in the public record, the Department:

 

(1) Concluded that sufficient evidence exists that the Sandy River from River Mile 0.0 to 37.5 meets the requirements of the federal test for title navigability; and

 

(2) Recommended to the State Land Board (Land Board) that it adopt the findings and conclusions contained in the report pursuant to OAR 141-121-0040 and, in so doing, assert a state claim to the bed and banks of the Sandy River below the line of ordinary high water from River Mile 0.0 to 37.5.

 

The Department presented this report to the Land Board for its consideration at its meeting on February 5, 2002. At the meeting. the Land Board adopted the findings and conclusions contained in the Final Sandy River Navigability Study Report. The board issued a written declaration pursuant to the requirements of OAR 141-121-0040(3) that states the nature and extent of the state’s claim to the land  underlying the Sandy River.
